Verdicts & Settlements
- State of Louisiana v. T.P. 15th JDC, Vermillion – Our client was charged with aggravated rape. His stepdaughter alleged that he forced her to have sex with him by brandishing a knife. After a thorough investigation it became apparent to the defense that the stepdaughter was fabricating the allegations because our client was the only parent disciplining her. The prosecution offered to reduce the charge if the client would agree to a thirty year sentence. The case proceeded to trial and our client was found not guilty.
- State of Louisiana v. K.C. 27th JDC, St. Landry Parish – Our client was charged with two counts of second degree murder. The prosecution alleged that our client and his co-defendant shot and killed two people after a fight at a nightclub. The co-defendant went to trial and was found guilty on both counts. During our client’s trial Kevin successfully argued that the methods used by the police to identify our client were faulty and the eyewitness identification by the witnesses was unreliable and tainted by the police’s faulty procedure. Our client was found not guilty on both counts.
- U.S. v. S.W. United States District Court, Western District of Louisiana – Our client was indicted for bankruptcy fraud in connection with the filing of numerous personal and business bankruptcies. The FBI conducted a search and seizure of a safe deposit box and located a large amount of cash. The cash was not listed as an asset in the pleadings filed with the bankruptcy court. During our investigation we uncovered bank records which allowed us to argue that at the time of the filing of the bankruptcies, our client had forgotten about the money in the safe deposit boxes. Seven members of the twelve person jury voted not guilty which caused a mistrial. The case was successfully concluded when the government offered for our client to plead guilty to a misdemeanor charge.
- State v. M.F. 15 th Judicial District Court, Acadia – Our client, a police officer, was indicted for manslaughter arising out of a shooting in the line of duty. The State Police conducted an investigation into the shooting and concluded that our client was not justified in using excessive force. The State’s primary witness was an instructor from the State Police Academy. After vigorous cross examination, a twelve person jury voted unanimously to acquit our client.
- U.S. v. S.M. United States District Court, Western District of Louisiana – Our client was charged with illegally intercepting satellite signals. The government claimed that our client was using software to re-program DirecTV program cards to illegally intercept DirecTV’s satellite signal and obtain DirecTV programming without paying for it. The FBI raided his office and located the equipment and software used to re-program cards in his desk. During our investigation we learned that his business partner was seen prior to the search walking around the office with the re-programming equipment. Kevin argued to the jury that the clients business partner planted the illegal devices so she could steal the business. The jury found our client not guilty on all counts.
