Biographical Information
Erby Fischer has been trying cases in Alabama courtrooms for almost 20 years. Erby attended the nationally top-tier ranked University of Alabama School of Law in Tuscaloosa. In fact, his talent as a trial lawyer revealed itself even prior to graduation, as Erby received national recognition when he was named the American College of Trial Lawyers’ Most Promising Trial Lawyer as well as being an ATLA Trial Competition National Semi-Finalist in 1995.
Erby’s focus is on helping those who have been harmed by the wrongs of another using the benefits that only a boutique litigation law firm can provide. Erby obtained his first multi-million dollar jury verdict before he was 30 years old. Over the course of his career, Erby has already secured settlement agreements and verdicts valued in excess of $170,000,000.00.
Peer reviews of Erby Fischer have resulted in the award of an AV rating by Martindale Hubbell. This is the highest rating awarded by Martindale Hubbell for excellence and ethics. Over the course of his career as an Alabama injury lawyer, Erby has handled automobile accidents, car crashes, premises liability (slip and fall) cases, trucking accidents, products liability, environmental cases, insurance fraud and bad faith lawsuits, as well as drug and business litigation. Today, the majority of the cases that Erby handles are catastrophic personal injury and complex commercial litigation matters. Erby Fischer has a particular compassion and interest in helping victims of trucking accidents which often result in death or catastrophic injury.
Erby recently concluded sprawling litigation spanning nine years. The litigation grew out of the failure of three Risk Retention Groups that insured thousands of individual and entities. Erby represented the Commissioner of the Department of Commerce and Insurance for the State of Tennessee in her role as Receiver for the Risk Retention Groups. Asset recovery actions were prosecuted on behalf of the Receiver and, ultimately, the creditors of the Receivership received complete relief for their claims.
Erby Fischer has tried to jury verdict many personal injury lawsuits that have resulted in six and seven figure awards. Erby Fischer has recovered millions of dollars in settlements in cases ranging from trucking cases to pharmaceutical injury cases and has achieved significant success settling multi-million dollars claims in fraudulent business and commercial cases. Erby has significant trial experience representing business ventures and commercial enterprises who have been harmed by the wrongdoing of another, either by breach of contract or by intentionally tortious conduct.
Earlier in his career, Erby volunteered at the University of Alabama, School of Law as an instructor in the Trial Advocacy Program, teaching students the art of trial skills and attending competitions.
Recognized by his peers for his experience in complex injury cases, Erby has written and lectured in continuing legal education seminars on a variety of legal topics including the successful prosecution of Alabama truck accident cases involving serious injury or wrongful death.
Erby has volunteered his time to serve on the board of institutions committed to assisting disadvantaged, disabled and at risk families.
